Wouldn't the image count as Copyrighted for the purpose of ImageShack's No Copyrighted Images restriction, though?

The following types of files constitute "abuse" may not be uploaded under any circumstances:

* Pornographic files. This includes, but is not limited to, files depicting genitalia, nudity, or sexual situations.
* Files that are illegal and/or are in violation of any United States laws.
* Files that infringe on the copyrights of any entity excluding the user.
* Non-image or non-swf files. This includes archived non-image files.
* Files intending to harass or spam, or promote anything for commercial profit.


I don't know what kind of copyright does that image have, but if it's allowed to use it as an avatar then it should be OK to upload it, since you don't make any profit from it.
Anyway I'm no lawyer, is there anyone who can give a detailed speech?

You don't stand to profit from the use of avatars. The use of these avatars has "virtually no effect on any potential market for or value of the copyrighted work". You're good.

If someone started using the cast of Squishy as avatars on a totally unrelated page I wouldn't be able to do much about it. It's commonly accepted that most images available are fair game when it comes to making avatars. Truth be told, that'd be nice free publicity. I have on more than one occassion asked an avatar user where they got their pic from, and was then led to pretty sites. (It's how I found Count Your Sheep).

Now, if someone decided to post the Squishy cast as XBox Live gamer pics, THEN I'd have something to fight for. Someone else would be profiting from my hard work, or (if they posted it for free) I would then be denied profiting from my hard work.

As for that particular site's rules, same deal. You are not making a profit, you're not denying profits, you're not INTENDING to harrass or promote (that one's tricky). So, again, you're good.

Win2K I can understand since it's damn near bulletproof, but 98? Is this so that you can continue to play old Command and Conquer games over a decade after they came out? if so, you should be playing Total Annihilation instead, under WinXP. Conveniently, it works perfectly.

Yeah I use it to run a bunch of older games/apps since I already set up a frame work for them. I do have "Total Annihilation" running a Star Wars mod somewhere around here. When I get a new comp and upgrade to XP I'll dual-boot down to Win2k.

*cranks up "System Shock 2" and considers playing 'Dune II" again while it loads*

And thank you muchly Madcat. Once I figure out how to save/extract the images from the links (feeling lazy at this very second) I'll just drop them into my own personal space and host from there:)

If that's totally okay with you that is, don't want to just assume.
